Legal practices
The Supreme Court of the Russian Federation (SCRF) has initiated a large-scale review of judicial practice in cases involving artificial intelligence (AI) technologies.
The goal of this work is to develop unified approaches to resolving disputes in this new and dynamically developing field.
Courts will need to analyze how often AI causes offenses, who should be held liable for damages resulting from its decisions, and how to protect honor, business reputation, and intellectual property in the face of the spread of deepfakes and the use of neural networks to create content.
Particular attention will be paid to the recognition of documents and opinions generated by neural networks as evidence, as well as complaints about the use of AI by judges in rendering verdicts.
Based on the results of the study, the SCRF will prepare recommendations to ensure consistency in judicial practice and submit proposals to legislators for improving legal regulation in this area.
Conclusion:
Lawyers should closely monitor the development of judicial practice in cases involving AI. This will allow for timely adaptation of defense and prosecution strategies, taking into account new types of evidence and the risks associated with the use of artificial intelligence. It is important to be prepared for the development of new legal positions and possible changes to legislation regulating AI.
